General Terms and License Conditions

1. Scope

These terms apply to the use of the BandAssist software and to the Band and Pro licenses and the passes. The provider is Martin Schumacher (address in the legal notice).

2. Purchase via Link

Licenses and passes are sold through Link, Stripe’s payment service. Link acts as the seller (“merchant of record”): the purchase contract, payment, invoices and receipts are handled by Link, and Link’s terms also apply to them. These terms govern how you may use BandAssist with your license.

3. Packages and trial month

BandAssist Free is free of charge. On every computer all features are available for 30 days from the first start; after that Free applies unless a license has been added. Which features and limits belong to Free, Band and Pro is shown on the pricing page; the state at the time of purchase applies.

4. Right of use

With your purchase you receive a simple, non-transferable right to use BandAssist within the scope of the purchased package – on as many computers at the same time as the license states (usually one). Devices that connect to this computer over the network (such as the band’s phones and tablets) are included. The license is activated online once and bound to the computer; for another computer, remove it in BandAssist and add it there again. You may not pass the license key on to third parties or publish it.

6. Activation and confirmation

BandAssist needs internet once to add the license. After that, BandAssist briefly confirms the license online every few weeks; without internet it remains valid for up to 60 days. If confirmation is not possible for longer, or a license has expired or been refunded, Free applies again after the next start. Your data in BandAssist is always kept.

7. Prices and refunds

The prices at the time of purchase apply, including VAT. Within 14 days of purchase I will refund the full amount on request, no questions asked (see Withdrawal and money back). A refund ends the license.

8. Defects

The statutory provisions apply. BandAssist controls mixing consoles, lighting and other devices: check settings and procedures before a gig, and use the “Reset” function to undo changes. Which consoles and devices are supported is stated on the website.

9. Liability

I am liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. In cases of slight negligence I am only liable for breach of an essential contractual obligation whose fulfilment makes use possible in the first place and on which you may rely, and only up to the amount of the foreseeable, typical damage. For free use (Free and the trial month) I am only liable for intent and gross negligence.

How your data is processed during purchase and activation is described in the privacy policy.

11. Changes

For lifetime licenses and passes already purchased, the terms at the time of purchase apply. If the terms for the annual subscription change, I will announce this at least six weeks before the next renewal; you can then cancel effective at the end of the term.

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of the country you live in remain unaffected. I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Should a provision be invalid, the remaining provisions remain valid.
